The U.S. Supreme Court unanimously ruled that the Trump administration must “facilitate” the return of Kilmar Abrego Garcia, a Maryland resident who was erroneously deported to El Salvador.
Abrego Garcia had been granted protection from removal due to threats from gangs in his home country.
Despite this, he was deported and subsequently detained in a high-security prison in El Salvador. The Court’s decision emphasized that the government’s actions violated legal protections and due process rights.
Trump Administration’s Response and Legal Challenges
Following the Supreme Court’s ruling, the Trump administration has been criticized for its slow compliance.
A federal judge demanded daily updates on efforts to return Abrego Garcia, highlighting concerns over the administration’s commitment to the Court’s directive.
Additionally, the administration’s broader immigration policies, including the use of the Alien Enemies Act to deport individuals without adequate legal review, have faced legal setbacks. The Supreme Court temporarily halted such deportations, asserting the need for judicial oversight.
